Trump Can Be Sued For Encouraging Violence Against Protesters At A Campaign Rally, A Judge Says

A federal Kentucky judge has ruled that President Donald Trump's rhetoric during a campaign rally last year provoked violence against three protesters, rejecting his defense that it was free speech.

Kashiya Nwanguma, Molly Shah, and Henry Brousseau, said they attended the Louisville, Kentucky, rally last March to "peacefully protest Trump." His supporters then shoved, punched, and forcibly removed them from the event after the then presidential candidate yelled, "get 'em out of here" several times.

US District Judge David J. Hale ruled Friday that the suit against Trump, his campaign, and three of his supporters will go forward. The president's lawyers tried to dismiss the suit, arguing that Trump was using free speech and was not instructing the crowd to use force. Hale disagreed, citing violence at previous Trump rallies and noting the unrest started as soon as Trump told the crowd to remove the protesters. The Supreme Court has also ruled that speech that incites violence is not protected by the constitution.

"It is plausible that Trump’s direction to “get ’em out of here” advocated the use of force," he wrote, stating that Trump should have known his statements would provoke violence. "It was an order, an instruction, a command."

The protesters had filed a lawsuit after the March 1, 2016, rally, claiming that Trump encouraged violence and that they were the targets of racial and sexist slurs.

Hale noted this particular incident, saying that Trump's directive to "eject a black woman when several members of a group that Trump knew or should have known was a recognized hate group were present in the audience, was entirely reckless."

Trump's lawyers had argued that the three supporters did not start pushing the protesters because Trump told them to, that they were acting on their own initiative.

However, one of the protesters, Alvin Bamberger, later apologized for his actions. In a letter to the Korean War Veterans Association, whose uniform he wore at the rally, Bamberger recalled that “Trump kept saying ‘get them out, get them out’ and people in the crowd began pushing and shoving the protestors . . . I physically pushed a young woman down the aisle toward the exit."

As the clash unfolded, Trump told the crowd "Don't hurt 'em. If I say, 'Go get 'em,' I get in trouble with the press."

Hale pointed out that if Trump had wanted these protesters removed he would have asked his security personnel to escort them out and "instructed the intervening audience members to stop what they were doing, rather than offering guidance on how to go about it."

One Child Has Died And Five Others Were Injured Because Of A Toxic Gas Leak At An Indoor Hotel Pool

A 13-year-old boy has died and five others were injured at an indoor swimming pool at Michigan Quality Inn & Suites Saturday morning, police said.

A toxic carbon monoxide leak is believed to have caused the deadly incident, Niles City Police officials told BuzzFeed News in a statement.

Capt. Don Wise of the Niles Fire Department told reporters at the scene that a hotel worker found the children passed out on the pool deck, prompting the first emergency call just before 10 a.m. Saturday.

Officials said carbon monoxide detectors immediately detected toxic levels of the odorless gas in the pool room when they first went in and they were able to pull the children out as they were leaving the room.

"All the responders took a little bit of a risk as they tried to pull the kids out," Wise said.

One Niles city officer, a Barrien County deputy, and two hotel employees were also treated for overexposure to the gas, police said.

The children were between 12 and 14 years old, police said.

Officers quickly started to check if the children were breathing and began conducting CPR on those who needed it, according to the statement.

One of the children, identified as 13-year-old Bryan Douglas Watts of Niles, was unable to be revived and was pronounced dead at a nearby hospital.

Local NBC affiliate WNDU reported that officials told them a malfunctioning pool heater is believed to have been responsible for the carbon monoxide leak. They also reported that there was no carbon monoxide detector in the area of the pool.

Wise told reporters a non-toxic level of carbon monoxide is about 50 parts per million. The pool room where the children were discovered was found to be at 800 parts per million when firefighters first entered.

The gas is odorless and, though early effects could cause dizziness and flu-like symptoms, it can go undetected, officials said.

"At those levels they don't have much time before they go unresponsive," Wise told reporters.

Police said officers conducted a room-to-room evacuation of the hotel, including some areas that were found to have high traces of carbon monoxide.

One child found in a first-floor room at the hotel told officers she had been in the pool room earlier with the other six children, and she was treated.

The hotel has been closed for the time being, police said.

Tara Chavez, whose son attends Desert Cove Elementary, told BuzzFeed News that she noticed the mark when she picked her child up from school on Thursday.

“He said, ‘Hey mom, I got stamped,’” Chavez recalled. (Chavez asked that her son's name not be used for this article).

Chavez said that when her son showed her the inside of his wrist it said “Lunch Money” in capital letters.

“My kid’s really weird about stuff like that, so I asked if he was given a choice by the lunch lady and he said, ‘No, she just grabbed my wrist and put the stamp on.’”

“I was surprised,” she said. “Normally I get a slip in his folder when he needs more money.”

Chavez said her son told her that he was given a lunch despite the stamp, and that when she checked his account online, there was still 75 cents remaining in it.

She said her son was embarrassed, which is what bothered her most about the incident.

“He was screaming and crying the entire time,” Chavez said. “He was humiliated, didn’t even want me to take a picture of it.”

Chavez emailed Desert Cove principal Stacey Orest about the stamp and provided a copy of Orest's response to BuzzFeed News.

"[The staff member in the cafeteria] doesn't want the students to be embarrassed either so she is supposed to ask them if they want a stamp or a reminder slip," the principal wrote.

Orest said in her email that she would discuss the incident with the staff member on Friday,

Chavez’s friend, Juan Fortenberry, posted the photo of the boy's stamp on his Twitter account on Saturday morning, where it soon went viral.

“I think there’s a better way to communicate the message than stamping a child with the word ‘Lunch Money,’” Chavez said. “There’s a billion other ways you could do it that would be better than that.”

Staff at Desert Cove Elementary did not immediately respond to a request for comment on Saturday.

Fire officials told Agence France-Presse that of the 18 people injured, five were hurt seriously, including a child.

"The structure was made of plywood, and when it was illuminated using gasoline, there was a blast," a police official told AFP. "Sparks and pieces of wood were thrown, injuring several people."

A witness told Le Parisien the person who lit the bonfire was thrown several feet by the blast.
