Court Rules Mexican Teen Fatally Shot By Border Patrol Was Protected By U.S. Constitution

The teen’s parents can now go ahead with a lawsuit against the agent who killed their son.

A federal appeals court Monday ruled that a Mexican teen who was fatally shot by Border Patrol was protected by the U.S. Constitution despite being on Mexican soil when the incident occurred.


The ruling by 5th U.S. Circuit Court of Appeals means the teen's family can go ahead with a lawsuit against the agent who shot him. It reverses a decision by a lower court that said the family could not sue because the effects of the shot were felt in Mexico.


The case involves the family of Sergio Adrian Hernandez Guereca, who died at age 15 after he was shot in the face by Border Patrol agent Jesus Mesa.


In 2010, Hernandez and some friends in Ciudad Juarez were playing a game that involved running up to the border near El Paso, Texas. When one of the boys was detained by a Border Patrol agent, Hernandez fled and hid behind a pole. Mesa fired at least two shots across the border, one of which hit Hernandez in the face, killing him, according to court documents.


The family sued agent Mesa, the U.S. government, the Department of Homeland Security, the Justice Department, and several of Mesa's supervisors, claiming that Hernandez's Fourth and Fifth Amendment rights had been violated. A district court dismissed the charges, and the family appealed.


The appeals court Monday upheld the majority of the lower court's ruling, relieving the agencies and supervisors of responsibility, but said the claims against the federal government and Mesa were valid. Both the government and Mesa can appeal the decision.


In the court's ruling, Circuit Judge Edward C. Prado wrote that immigrants inside the U.S. "are entitled to feel free of gross physical abuse by federal agents," and that not extending that right to a person just across the border "would establish a perverse rule that would treat differently two individuals subject to the same conduct merely because one managed to cross into our territory." The approach would create "zones of lawlessness," Prado wrote.


The American Civil Liberties Union filed an amicus brief in the case, arguing that there is no basis for the government's position that the Constitution does not apply abroad, following a Supreme Court decision on Guantanamo. Leaders at the legal advocacy organization applauded Monday's ruling.


"Any other result by the court of appeals in this case would have meant that border patrol agents could continue to shoot Mexican nationals such as this 15-year-old child with impunity, free from judicial oversight," Lee Gelernt, Deputy Director of the National ACLU's Immigrants' Rights Porject, said in a statement. "The court properly rejected the notion that the federal government can monitor itself, especially in such an egregious case."

What Happens When A Prep School's Black Student President Mocks Her White Male Classmates

An Instagram photo allegedly led the country’s most expensive boarding school to strip its first black female student body president of her role.

One day last March, Lawrenceville School Student Body President Maya Peterson donned L.L. Bean boots and a Yale University sweater to pose for an Instagram photo depicting what she described as a typical "Lawrenceville boi": white, Republican, and cockily holding a hockey stick.


Peterson, who graduated in June, added hashtags like "#romney2016," "#confederate," and "#peakedinhighschool" before posting. It was a joke, she said, inspired by classmates who complained to the school's dean of students about Peterson's own senior photo, in which she and 10 friends, all black, raised their fists in a "Black Power" salute. But not everyone thought it was funny.


"You're the student body president, and you're mocking and blatantly insulting a large group of the school's male population," one student commented on the photo.


"Yes, I am making a mockery of the right-wing, confederate-flag hanging, openly misogynistic Lawrentians," Peterson responded. "If that's a large portion of the school's male population, then I think the issue is not with my bringing attention to it in a lighthearted way, but rather why no one has brought attention to it before…"


Three weeks later, the administration told Peterson she would face disciplinary action unless she resigned from her post as student body president, she said. Peterson was the first black woman to serve in that role at The Lawrenceville School, a prestigious boarding school near Princeton, N.J., that costs around $53,000 a year to attend, making it the most expensive high school in the country.


A critical mass of faculty members and students believed "it was not fitting of a student leader to make comments mocking members of the community," Dean of Students Nancy Thomas told the Lawrenceville student paper. But the photo was simply the last straw for many white students who never wanted Peterson to be president in the first place — and for Peterson herself, who said she was sick of fighting vicious attacks from the most privileged members of the elite school.

The Lawrenceville School, founded in 1810, first admitted black students just 50 years ago. Female students weren't allowed to enroll until 1987, a change that led 50 students to shout "Better Dead Than Coed" in protest, according to the Philadelphia Inquirer ("We were told they'd be so much smarter. They're morons, most of them," one senior boy elaborated). Notable Lawrenceville alumni include famous CEOs (Michael Eisner, Lewis Bernard), state senators, and the founder of Forbes magazine.


Peterson, a tall, animated 17-year-old with flowing dreads and thick-rimmed glasses who ran on a platform of "inclusion and acceptance and pride in oneself," wasn't just the first black woman to serve as student body president — she's an out lesbian too. She won the election by reaching out to students whom other candidates overlooked, including freshmen and minorities, other students said.


"The younger kids told me they felt comfortable opening up to me in a way they didn't with other people," Peterson said.


Chris, a 2014 graduate whose education was funded by a program called Oliver Scholars, a program for New York City students of African and Latino descent, said Peterson won because "she really cares about people and their best interests." To Chris, a transgender student, Peterson "came off as somebody who would advocate for us."


One of Peterson's first acts as president was to institute a "diversity representative" on the student council board to eliminate tension on campus when talking about race and gender issues. But her diversity initiatives were not widely welcomed; a push for gender neutral bathrooms was particularly controversial. And Peterson herself was viewed with suspicion by a significant number of students, mostly white and male, who opposed her candidacy from the start. Some even thought the school had rigged the election so that a woman would win; only two women served as student body president before Peterson.


"There was outcry for Lawrenceville to release the voting data for her presidency, because popular opinion was that she was not actually elected," said David, a 2014 graduate. "I'd still like to see those numbers, is all I'm saying." (The numbers were, in fact, released.)


The backlash to her election led to personal attacks. Shortly after Peterson was elected, an anonymous student sent the dean of students photos of Peterson using marijuana. Soon after, the school received more anonymous information that alleged Peterson had posted racist tweets about a Sikh student. In a school-wide meeting, Peterson apologized for the photos and the dean of students clarified that the racist tweets were fabricated. Still, many students believed she wasn't right for the position.


"There was too much controversy around Maya," said Rob, a rising senior. "We didn't really want a president who breaks school rules. It isn't a representation of who we are."


Peterson was frustrated that the school didn't investigate her anonymous attackers, even after another scary incident in the winter, when someone sent an email to the freshman class containing photos of Peterson half naked in her room. Peterson had no idea where the sender had gotten those photos, she said, and the administration, while sympathetic, didn't either — or didn't tell her if they did.


By spring, Peterson was sick of feeling unsupported, and the complaints about the "Black Power" yearbook photo set her off.


"I understand why I hurt people's feelings, but I didn't become president to make sure rich white guys had more representation on campus," she said. "Let's be honest. They're not the ones that feel uncomfortable here."

Mayor Rob Ford Returns To Work, Says Rehab "Saved My Life"

After spending the last two months in rehab, Toronto Mayor Rob Ford returned to City Hall Monday, where he apologized to the people of the Toronto, promised to have ended his associations with certain bad influences, and declared that his commitment to "living clean is unwavering."


"Thanks to my treatment, I can proudly say today that I have begun the process of taking control of my life," Ford said at a news conference Monday.


Ford said he underwent hundreds of hours of therapy at GreenStone rehabilitation center in Ontario where he "learned about things, like triggers, and what happens when you have uncontrollable cravings."


"I learned that my addiction is really a disease. A chronic medical condition that will require treatment for the rest of my life," Ford said.


An emotional Ford teared up as he apologized to his family for his past actions. He went on to thank the media for their privacy during his two months stint at GreeneStone.


Ford ended the news conference, which was attended by about 20 handpicked members of the media (it was reported earlier Monday that Ford's administration was barring certain media outlets from covering the news conference), with a firm declaration that he would not bow out of his 2014 re-election campaign.


"I look forward to serving you for many, many more years," Ford said, before walking away from the podium without answering any questions.

The trial of Oscar Pistorius resumed in Pretoria on the morning of June 30 after a monthlong evaluation in which a psychologist and three psychiatrists determined whether or not Pistorius understood the difference between right and wrong when he shot Steenkamp. Prosecutor Gerrie Nel noted that the experts believed Pistorius was "capable of appreciating the wrongfulness of his act."


Pistorius was evaluated as an outpatient at Weskoppies Psychiatric Hospital in Pretoria, and had been staying at home of his uncle as he is free on bail.

Here Are The Cities Where The Rent Really Is Too Damn High

New data from Harvard shows that millions of Americans are paying an “excessive” amount of their incomes on housing, but burdens vary widely by city.

The report explains that in 2012 there were 40.9 million families and individuals in "cost-burdened" households, or those paying more than 30% of their income on housing. And while that number is a slight decrease from 2011, it represents an uptick of more than 9 million households from 2002. Minority and lower-income households are particularly suffering, according to the report, and renters in general are faring poorly due to income declines.


The report also explores "severely burdened" households — or those paying more than 50% of their income on housing — and notes that the data is "particularly alarming." In 2012, for example, more than a quarter of all American renters fell into this category. Among black households, 27% were severely burdened, as were 24% of Latino households and 21% of Asian households. Only 14% of white households were severely burdened.


The report includes an interactive map that shows what percentage of a metropolitan area's households are suffering from too-high housing costs. The Los Angeles metro area takes the top spot, with 2.1 million households suffering from cost burdens. That's just shy of 50% of all households in the Los Angeles area:

Stepmother Who Put Detroit Boy In Basement Allegedly Told Him "Not To Come Out," Didn't Feed Him

Charlie Bothuell V was also reportedly found with scars around his body that suggest previous abuse.


The statement was revealed in court documents filed after the Thursday arrest of the boy's stepmother, Monique Dillard-Bothuell, who allegedly barricaded Charlie behind boxes in the basement of the multiple-unit condo where they lived.

A bloody PVC pipe was found in the home by investigators, and "Mr. Bothuell disclosed physically disciplining Charlie V with [it]," police said.


The Detroit Free-Press obtained a petition filed Friday in Wayne County's juvenile court regarding Charlie's two younger siblings, age 4 and 10 months and both autistic, being removed from their parent's custody by Children's Protective Services. In it, the physical abuse Charlie reportedly suffered is detailed.



Monique Dillard-Bothuell was arraigned for an unrelated probation violation of weapons charges at Frank Murphy Hall of Justice in Detroit on Friday.

8 Important Questions About California's New Sexual Assault Bill

Lawmakers in California are currently considering Senate Bill 967, which would require any school that gets state funds to adopt an array of sexual assault policies. The bill is the brainchild of California State Senator Kevin de Leon, who told BuzzFeed in a recent interview, "There's a rape culture that's pervasive on many college campuses." De Leon wants to change the culture and believes his bill is a step in that direction. The bill deals only with the way colleges handle sexual assault and does not change law enforcement policy. It also leaves it up to schools to determine who will conduct investigations, and survivors would get to decide if any police should be involved.


The specific policy mandates of the bill are fairly straightforward. Schools would have to provide sexual assault-related orientation, crisis centers, counseling, and other services. However, one aspect has captured more attention than anything else: "affirmative consent."


The idea is that two people must clearly give consent before having sex, and the bill's language makes clear that both people participating in an intimate encounter are responsible for obtaining that consent:



It is the responsibility of each person involved in the sexual activity to ensure that he or she has the affirmative consent of the other or others to engage in the sexual activity.



That may sound obvious — lack of consent equals rape, right? — but it's actually a significant shift away from the idea of "no means no," where at least some of the responsibility fell on those who ended up as victims. Under de Leon's law, no means no, but so does not somehow saying yes. The law also makes clear that a person who is drunk or asleep, among other things, can't consent to sex. "We're changing the status quo," de Leon said to BuzzFeed.

Funding For Golden Gate Bridge Suicide Barrier Is Approved

"The tragedy of today is that we can't go back in time, we can't save ... the people who jumped off the bridge. But the good thing, with this vote today, we can vote in their memory," a bridge district board member, Janet Reilly, told the AP, after the funding package received a unanimous vote of approval from the board of directors.


The bulk will come from federal funds along with $20 million in bridge toll revenue and $7 million pledged by the state.


The Golden Gate Bridge is the top suicide spot in the U.S. and one of the most popular suicide sites in the world. An estimated 1,600 people have committed suicide by jumping off the bridge since it opened in 1937.

Last year, a 46 people committed suicide by jumping off the bridge and another 118 were stopped by bridge workers, amounting to a suicide or an attempt almost every other day.


Those who jump drop 220 feet to their death after suffering massive internal injuries, internal bleeding, skull fractures. Others die by drowning.


The proposal for a suicide barrier was discussed for decades before the board voted in 2008 to install a stainless steel net which would stretch 20 feet wide on each side of the span. The obstacle of funding was overcome when President Obama signed into law a bill that made safety barriers and nets eligible for federal funds in 2012.

Mubarak Bala was apparently committed to Aminu Kano Teaching Hospital by his family on June 13. An IHEU-affiliated lawyer reportedly has visited Bala in the hospital and said he has become increasingly desperate. Bala also reportedly was sedated, and medicated.

Awe-Inspiring Pregnant Woman Runs 800 Meter Race At U.S. Championships

A five-time national champion, Alysia Montano, was ready for another race on Thursday. But this race would be just a little different, since the former University of California star was 34-weeks pregnant.


"I've been running throughout my pregnancy and I felt really, really good during the whole process," Montano said after the qualifying heat.


She finished last, but the crowd at Hornet Stadium still gave her a standing ovation. The 28-year-old ran the race in 2 minutes, 32.13 seconds. This comes about 35 seconds slower than her personal best of 1:57.34, which she ran in 2010 in Monaco.


Montano has been running all her life, and said she consulted with her doctor about her plan to continue running during her pregnancy, who encouraged the idea.


"That took away any fear of what the outside world might think about a woman running during her pregnancy," Montano said. "What I found out mostly was that exercising during pregnancy is actually much better for the mom and the baby. ... I did all the things I normally do ... I just happened to be pregnant. This is my normal this year."

Flight MH370 Crew Was Likely Unconscious As Plane Flew On Autopilot, Officials Say

More than 100 days after Malaysia Airlines Flight MH370 disappeared, Australian officials now believe the passengers and crew were likely unconscious as the plane cruised on autopilot over the southern Indian Ocean until it ran out of fuel and crashed.


In a 55-page report released by the Australian Transport Safety Bureau Thursday, investigators said the airliner's behavior suggested the 239 people aboard were unresponsive due to oxygen deprivation.


"Given these observations, the final stages of the unresponsive crew/ hypoxia event type appeared to best fit the available evidence for the final period of MH370's flight when it was heading in a generally southerly direction," the ATSB report said.


Investigators did not attempt to explain in the report why the plane made a sudden U-turn over the Gulf of Thailand while on its way to its intended destination of Beijing, before later flying back over Malaysia and heading for the Indian Ocean.


Australian Deputy Prime Minister Warren Truss told reporters at a news conference that investigators now believe the plane was likely flying on autopilot the entire time it was over the southern Indian Ocean.


"It is highly, highly likely that the aircraft was on autopilot otherwise it could not have followed the orderly path that has been identified through the satellite sightings," Truss said.


A new analysis of existing satellite data suggests the airliner likely traveled farther south over the Indian Ocean than the area most recently searched with underwater listening equipment, he said. The new search area is about 1,100 miles off the coast of Perth, Australia and several hundred miles southwest of the last suspected crash site.


"The new priority area is still focused on the seventh arc, where the aircraft last communicated with satellite," Truss said. "We are now shifting our attention to an area further south along the arc based on these calculations."


An underwater search of an area up to 60,000 square kilometers in size will begin in August and could take up to 12 months to complete. The search is already the most expensive in aviation history, according to Reuters.


"The new search area is most likely the place the aircraft is resting," Truss said.



A map released on June 26 shows the latest search area in the southern Indian Ocean for missing Malaysia Airlines Flight MH370.
