Judge Rules Boston Marathon Bombing Trial Will Remain In Boston

Federal judge denies a change of venue request for accused marathon bomber Dzhokhar Tsarnaev. The trial start date was moved to Jan. 2015.


U.S. District Court Judge George O'Toole denied Tsarnaev's lawyers' argument that the high degree of media coverage would prevent him from getting a fair trial in the state of Massachusetts.


Tsarnaev's lawyers also requested a 10-month delay in the trial that was scheduled to begin on Nov. 3, citing a need for more time to do discovery. The decision to delay the start until Jan. 2015 gives both sides two additional months to prepare.


Tsarnaev, 21, faces the death penalty if found guilty of the bombing that killed three people and injured more than 260 others at the 2013 Boston Marathon.
